The Learned APP Mr. Kapadnis states that the charge sheet has been filed in the year 2011. The Petition has been filed in the year 2017. The quashing of the charge sheet is sought on the ground that there is no material which is cited against the Petitioner herein. In view of the fact that the charge sheet has already been filed as long back as in the year 2011, we do not deem it appropriate to go into the veracity of the claim of the Learned Counsel for the Petitioner. It would be open for the Petitioner to file an appropriate application before the Trial Court for his discharge. If any such application is filed, needless to state that the same would be tried on its own merits and in accordance with law. With the observations as aforesaid, the above Writ Petition is disposed of.
