The impugned order being interlocutory in nature capable of being challenged under section 105(1) of the Civil Procedure Code, 1908. Hence, no interference under Article 227 of the Constitution of India is called for. However, it will be open for the petitioner to raise this contention in an appeal if the decree goes against the petitioner.

The writ petition is dismissed. No costs.
