This is an application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail.

The applicants came to be arrested in Crime No. 265 of 2023 registered at Shikrapur Police Station, for the offences punishable under Sections 386, 364(a), 323, 504, 506 r/w. 34 of Indian Penal Code. 3.

I have heard the learned Counsel for the applicant and the learned APP for the State.

According to the prosecution, on the date of incident which took place on 22 March 2023, the present applicants demanded hafta Kanchan P Dhuri 1 / 2

937-BA-1159-2023.odt (extortion money) of Rs.20,000/- per month from the complainant, who is in construction business, to allow him to do the said construction work in their village.

According to the complainant, six months prior to the alleged incident dated 22 March 2023, under threat applicants extorted Rs.1 lakh from him. The complainant has not assigned any reason as to why the report was not lodged at that time. There are no other criminal antecedents. Considering the overall facts and circumstances, I am inclined to release the applicant on bail. Hence, the following order is passed :

(i) Application is allowed.

(ii) The applicant No.1-Rushikesh Ashok Darekar and applicant No.2-Ratan Dattatray Kamthe, be released on bail in Crime No. 265 of 2023 registered at Shikrapur Police Station, for the offences punishable under Sections 386, 364(a), 323, 504, 506 r/w. 34 of Indian Penal Code, on furnishing P.R. Bond in the sum of Rs.25,000/- each with one or two sureties in the like amount.

(iii) The applicants shall attend the concerned police station once in a month i.e., on first Saturday between 11.00 a.m. to 2.00 p.m. till conclusion of trial.
