By an order dated 24.3.2017, this Court had directed the applicant to approach Progressive Co-operative Bank Ltd. for one-time settlement as per the negotiations with the Bank. It was also directed that the applicant shall deposit an amount of Rs.13,50,000/- on or before 21.4.2017.

The learned counsel for the applicant submits that due to inevitable circumstances, he could not deposit the said amount which is a principal amount in the Bank. Today, the learned counsel for the applicant has submitted that he would pay the said amount by a pay order on or before 12.5.2017. The Bank shall accept the same. The applicant shall clear the

Mhi 2 APPP-411-17.sxw NPA standing in the name of the complainant in the said loan account on or before 19.5.2017. The police shall record a panchnama of the jewellery which is mortgaged with the Bank which is in the locker of the Bank. The respondent shall not operate the Bank locker and shall also take photograph of all the jewllery. The Magistrate seized with the matter shall demarcate the jewellery belonging to the complainant and the applicant as well on or before 15.6.2017.

With these observations, the application stands disposed of. 4.
