The petitioner herein had challenged the Order of issuance of process under Section 138 of the Negotiable Instruments Act. 2.

Mr.Narayan, learned Counsel for the respondent, under instructions states that the respondent does not wish to prosecute the petitioner for offence under Section 138 of the Negotiable Instruments Act. He has submitted that the application to drop the petitioner as accused could not be filed earlier in view of the stay operating in these matters. He further states that the respondent complainant shall file proper application before the 14th Court/ i/c. Court, Girgaum, Mumbai within 8 days for dropping the petitioner as accused from the said cases. Statement accepted. 3.

The learned Counsel for the petitioner, under instructions, seeks leave to withdraw the petition, with liberty to take out appropriate petition for damages, if the petitioner so desires. 4.

In view of the statement made by the learned Counsel for the respondent, leave with liberty granted. Petitions are dismissed as withdrawn.
