This is an application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail.

The applicant came to be arrested in Crime No.84 of 2020 registered at Paud Road Police Station, Pune (Rural) for the offences punishable under Sections 365, 386, 395 r/w. 34 of Indian Penal Code and Sections 3(1)(ii), 3(4) of the Maharashtra Control of Organized Crime Act, 1999.

According to the prosecution, the present applicant is a member of organized crime syndicate formed by co-accused Shubham Gole. The allegations against the present applicant and other co-accused are of abduction and extortion.

I have heard the learned Counsel for the applicant and the learned APP for the State.

I have perused the FIR. The FIR is against unknown person. In that view of the matter, it was necessary to conduct TI Parade, however, it appears that same is not conducted. Prima facie, there appears to be no material on record to connect the applicant with the alleged organized crime syndicate formed by Shubham Gole. There are no other criminal antecedents. The applicant is in jail for about 2 years 9 months. 6.

Considering the overall facts and circumstances, I am inclined to release the applicant on bail. Hence, the following order is passed: (i) Application is allowed.

(ii) The applicant - Haridas Dinkar Shedge be released on bail in Crime No.84 of 2020 registered at Paud Road Police Station, Pune (Rural) for the offences punishable under Sections 365, 386, 395 r/w. 34 of Indian Penal Code and Sections 3(1)(ii), 3(4) of the Maharashtra Control of Organized Crime Act, 1999, on furnishing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount. (iii) The applicant shall attend the concerned police station once in a month i.e., on first Saturday between 11.00 a.m. to 2.00 p.m. till conclusion of trial.
