Learned counsel Shri Gokhale was previously appearing on behalf of the appellants. It is pointed out that after appellant No.1 died, his legal heirs were brought on record. Learned counsel Shri S.H. Deokar is representing the legal heirs of original appellant No.1. Learned counsel Shri Gokhale pointed out that the appellant No.2 had instructed him not to appear on behalf of appellant No.2 as even the appellant No.2 would be represented by learned counsel Shri S.H. Deokar. The communication to that effect has been addressed by learned counsel Shri Gokhale to the appellant No.2.
