Heard the learned counsel for the applicant and the learned APP.

This is an application seeking relaxation of conditions imposed upon the applicant by the Sessions Court while granting him bail under Section 439 of Cr.P.C.

The applicant herein is arrested on 14th December, 2014 in Crime No.358 of 2014 registered at Pant Nagar Police Station for the offence punishable under Section 420 read with Section 34 of IPC. 4.

By an order dated 2nd February, 2015, the learned Sessions Judge was pleased to enlarge the applicant on bail on the condition that he shall furnish P.R. Bond and surety to the tune of Rs.1 lakh and shall attend the Pant Nagar Police Station on every Monday between 9 a.m. to 12 noon.

Mhi 2 APPLN-277-15.sxw That the applicant could not comply with the said order as he was in jail and there was nobody responsible in the family to espouse his cause and, therefore, an applicant is seeking modification of the said order was filed before the Sessions Court. By an order dated 21.4.2015, the learned Sessions Court was pleased to modify the order to the extent that the applicant shall furnish more than one surety, but not exceeding four sureties. Hence, this application seeking relaxation of conditions. 5.

Taking into consideration the facts of the case and that the applicant was enlarged on bail on merits, this Court is inclined to modify the order as follows :-

O R D E R

(i) The applicant herein shall be enlarged on cash bail of Rs.1 lakh (Rupees one lakh only) for a period of four weeks from the date of release. After four weeks the applicant shall comply with the order dated 21.4.2015.

(ii) The applicant shall attend the concerned police station on every Monday between 9 a.m. to 12 noon.
