In view of the judgment of the Apex Court reported in (2005) 8 SCC 618 in the matter of SBP & Co. v/s. Patel Engineering Ltd and anr. which has been referred to by the Apex Court in the judgment reported in (2014) 7 SCC 255 in the matter of Lalitkumar V Sanghavi (Dead) Through LRs Neeta Lalit Kumar Sanghavi and anr v/s. Dharamdas V Sanghavi and ors. it is not possible to entertain the above Petition challenging the order passed by the Arbitral Tribunal. The above Petition is accordingly dismissed. However, it would be open for the Petitioner to raise the challenge raised in the above Petition, whilst challenging the Award passed by the Arbitral Tribunal, if the occasion so arises.
