This application is moved under Section 438 of Code of Criminal Procedure. The learned prosecutor points out that in this case police have invoked sections of MCOCA Act.

There is a legal bar under Section 21(3) of MCOCA that Section 438 of Code of Criminal Procedure cannot be attracted when sections of MCOCA are invoked.
