It has not been disputed by the learned Counsel appearing for the respondents - State that question involved in this Petition has already been considered and decided by various orders passed by this Court including in the case of Parbhani 1/3

Education Society, Parbhani Vs. the State of Maharashtra in Writ Petition No. 3707 of 2013 decided on 02/09/2013 as also in the case of Vinod Laxman Shelkar and anr. Vs. State of Maharashtra and anr. in Writ Petition No. 2207 of 2016 decided on 31/03/2016 in Writ Petition No. 2207 of 2016 and in view of order dated 04/05/2016 passed in Writ Petition No. 5440 of 2016.

In view of the aforesaid, we set aside the impugned order by directing respondent No.2 to consider afresh the proposal submitted by the petitioner for approval to the appointment of Ms.Phulabai Annappa Karande as Shikshan Sevak in the petitioner's institution in the light of the observations made in the aforesaid cases.

The decision as aforesaid be taken by the 2nd respondent within a period of 4 weeks from the date of the receipt of the copy of this order.
