Mr. Talkute, learned Counsel for petitioner and Mr. Oak, learned Senior Counsel for respondent No.3 in both the Petitions state that parties have amicably settled the controversy raised between them and to that effect, they have entered into consent terms dated 21.12.2015. 3.

Mr. Talkute states that petitioner Dr. Vinaykumar R. Mehta, petitioner in both the Petitions, is personally present in the Court. He has tendered photocopy of the passport, which is taken on record and marked 'X' for identification. Mr. Oak states that respondent No.3 Mr. Vidyadhar Vaidya, in both the Petitions, is personally present in the Court. He has tendered photocopy of PAN, which is taken on record and marked 'Y' for identification. Consent terms dated 21.12.2015 duly signed by the petitioner and respondent No.3 in both the Petitions and 1/2

Learned Counsel for the parties state that controversy between the parties is lawfully settled in terms of the consent terms and the Petitions may be disposed in terms thereof. Petitioner has undertaken to withdraw Contempt Petition No.158 of 2011 within a period of two weeks from today. Undertaking given in paragraph 4 of the consent terms is accepted.

After hearing the learned Counsel appearing for the parties and after perusing the consent terms, I am satisfied that the controversy between the parties is lawfully settled. Petitions are disposed of in terms of the consent terms marked 'Z'. Rule is discharged in both the Petitions.
