By this petition under Article 227 of the Constitution of India the Petitioner is seeking direction against the respondent to decide urgently the Appeal No.41 of 2017 preferred by them challenging the order dated 18.4.2017 passed by District Registrar (C.S.) Solapur under section 77A of the Maharashtra Cooperative Societies Act, 1960.
The learned counsel for the petitioner 1/3
submits that prayer clause (b) of the said petition becomes infructuous in view of the fact that the authority already passed the order on their stay application. He submits that he received instruction from his client that at present they do not want to press the present Writ Petition if court directs the authority to decide their Appeal No.41 of 2017 as early as possible.
The learned Senior Counsel for the respondent after taking instruction from the officer who is present in court makes a statement that they will dispose of Appeal No.41 of 2017 as early as possible but in any case within four weeks from today.
Statement is accepted.
In view of the statement made by the learned Senior Counsel for the respondent, the learned counsel for the petitioner seeks liberty to withdraw the present petition keeping their all contentions open.
The learned Senior counsel for the respondent after taking instruction from the officer submits that the petitioner be directed to remain present before the concerned Appellate Authority on Monday, 19.7.2017 at 11 a.m. so that they will decide for fixing early date of hearing. It is made clear that petitioner should not ask any adjournment and he should cooperate for disposal of the Appeal as early as possible.

No order as to costs.
