Today when the matter came up for hearing the only prayer made by the learned counsel for the Petitioner is to dispose of this Petition by directing Respondent No. 2/Special Land Acquisition Officer, Panvel to consider and take appropriate decision in regard to the Petitioner's application filed on 1st August, 2015 (Exhibit E) keeping in view the order passed by this Court in First Appeal (St.) Vishal Parekar 1/2

prod-22-wp-7965-2016 No. 14335 of 2008 with Civil Application No. 3649 of 2008 and No. 3650 of 2008 on 12th February, 2009 in case of the State of Maharashtra vs. Gajanan Pandurang Gandharkar and Others. 4.

Having regard to the aforesaid limited prayer without commenting upon the merits of the matter, this Petition is disposed of by directing Respondent No. 2 to consider and take appropriate decision on the Petitioner's aforesaid application in accordance with law as expeditiously as possible but not later than three months from the date of receipt of copy of this order.
