It is the contention of the learned Senior Counsel for the petitioner that respondent no.3 passed impugned order dated 20.4.2017 without giving any hearing. Same facts are admitted by the learned A.G.P. for the respondent after taking instruction from the concerned officer.

At this stage, the learned Senior Advocate for the petitioner submits that petitioner is ready and willing to maintain status quo as of today till the decision of the Additional Collector if matter is remanded back.

In view of this fact, following order is passed: a) Order dated 20.4.2017 passed by respondent no. 3 is set aside. b) Respondent no.3 is directed to pass afresh order after giving hearing to the petitioner as early as possible but in any case within 15 days from the receipt of copy of this order.

c) Petitioner to maintain status quo in respect of their mining activity as of today till the decision of the respondent no.3. d) Writ Petition stands disposed of accordingly. Parties to act on authenticated copy of this order. (A.K.MENON, J.) (K.K.TATED, J.) Mohite 2/2
