1] The applicant is apprehending arrest in M.E.C.R. No. 6 of 2005 dated 3.10.2005 registered with Nerul Police Station, Navi Mumbai under Sections 403, 404, 406, 418, 420, 465 of the Indian Penal Code 2] It is the prosecution case that the co-accused Sanjeev Gupta by forging signature of his mother namely Smt Paramjyotidevi Gupta tried to transfer 1200 sharers of UTI Company in his own name. The first informant is real brother of the coaccused Sanjeev Gupta. After completion of investigation, the police have submitted chargesheet.

Prima facie, it appears from the statements of witnesses that the said Sanjeev Gupta diverted the communication/correspondence between him and the company at the address of the applicant and the applicant in turn handed over the said letters and

Dond aba.809-2017.sxw other correspondence to Sanjeev Gupta. It appears from record that except aforestated the applicant has no other role to play in the present crime. 3] In view thereof, the applicant has made out a case for grant of interim relief. Hence, the following Order:

(i) In the event of arrest in M.E.C.R. No. 6 of 2005 dated 3.10.2005 registered with Nerul Police Station, Navi Mumbai, the applicant shall be released on bail on his furnishing PR bond of Rs.15,000/- with one or two local sureties. (ii) The applicant shall attend all dates before the Trial Court. (ii) The applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
