Civil Application No.3459 of 2007 is for condoning the delay of 219 days in filing the First Appeal. The First Appeal has been duly served on Respondent Nos. 1 to 3 and 5, whereas Respondent No.4 has been appearing through an Advocate. There is no reply on the part of the Respondents and none appears for the Respondents today. Accordingly, the civil application is allowed in terms of prayer clauses-(a) and (b). Office shall now number the First Appeal after removal of other office objections, if any, and place the same in due course along with Civil Application No.4213 of 2007.
