Heard learned counsel for the Applicant.

By this Application, the Applicant seeks interim protection till his Application, being Cri. Misc. Appln.No.336 of 2017 is decided by the Sessions Court. He submits that the main Application has been kept on 15.05.2017 and prays that the Applicant be granted interim protection in view of the peculiar facts of this case. He submitted that the Applicant had purchased land from one Thakkar, who in turn had purchased the land from the original owners and as such, there was no reason for the Applicant to know that three persons had impersonated the real persons before the Sub-Registrar. He submitted that valid consideration was paid to the sellers. Without going into the

ABA 817-17.doc merits of this case, since the main Application is pending, the Applicant is granted interim protection till the final disposal of his Application, being Cri.Misc. Appln. No.336 of 2017, on the following terms & conditions:- O R D E R (i) In the event of arrest, the Applicant be enlarged on bail, on executing PR Bond in the sum of Rs.25,000/- with one or two sureties in the like amount.

Accordingly, the Application is disposed of.

It is made clear that the observations made herein are prima facie, and the trial Court shall decide the main Application on its own merits, in accordance with law, uninfluenced by the interim protection granted by this Court. (REVATI MOHITE DERE, J.)
