In Crime No. 180/2018 registered with Kondhawa Police Station, Pune for offence punishable under Sections 143, 147, 154,

2 1.855.18 aba.doc 149, 452, 351, 504, 506(II) r/w 34 of the Indian Penal Code and Section 27 of the Arms Act, applicants are seeking pre-arrest bail. Offence came to be registered pursuant to an Order passed in exercise of powers under Section 156 (3) of Code of Criminal Procedure, 1973 by the concerned Magistrate.

The incident referred to is of 14/02/2018. It also appears that some of the members of the complainant's family are facing caste validity litigation at the behest of the applicant. Considering the political rivalry and order passed under section 156 (3) of Code of Criminal Procedure, 1973, in my opinion, custodial interrogation of the applicants is not warranted. In view thereof, following order:

(A) In the event of arrest of the applicants in Crime No. 180/2018 registered with Kondhawa Police Station, Pune, applicants be released on bail on furnishing P.R. bond in the sum of Rs. 25,000/- each with one or more sureties in the like amount.

(C) Applicants shall co-operate with the investigating agency.

(D) Applicants shall not issue threats to complainant or his family members.

Application stands disposed of.
