Mr. Yadav, learned Counsel appearing for the Petitioner, on instructions of Mr. Samsher Singh, who is present in the Court, seeks to withdraw this Petition with liberty to challenge the issues raised herein, if the Petitioner file an appeal from the final order passed by the City Civil Court. This in terms of Section 105 of the Civil Procedure Code, 1908. Liberty as sought for, granted.

The learned Counsel for the parties seek an expeditious disposal of the suit. Parties are at liberty to apply before the Trial Court. If the same is done, Trial Court will consider the same appropriately. Petition dismissed as withdrawn, with the aforesaid liberty. (M.S.SANKLECHA,J.) S.R.JOSHI
