This is an application by State for restoration of the first appeal, which was dismissed for non compliance of the Order dated 09.02.2009 about filing of private paper book. There is delay of 4 years 59 days in filing the application.

Learned counsel for the Respondent opposed the condonation of delay. However, record shows that despite the application being filed in March 2014, till date, no reply is filed. 3.

In that view of the matter and considering the averments in the application, sufficient cause is made out. Therefore, civil application is allowed in terms of prayer clauses (b) and (c). Delay Sneha Chavan page 1 /2
