Learned APP, on instructions from Special Public Prosecutor appearing before Trial Court, submitted that trial has proceeded. So far the prosecution has examined about 26 witnesses and the prosecution proposes to examine further six witnesses. Vide order dated 2nd February 2021 this Court had observed that learned APP has placed on record communication dated 1st February 2020 indicating that on day to day basis the subject trial is going on. It was also observed that prima facie it will not be proper to consider application for bail.

In view of the submission of learned APP, bail cannot be granted to the applicant. Hence, I pass following order :

ORDER

(i) Bail Application is rejected and disposed of; (ii) It is expected that trial would continue on day to day basis and conclude as early as possible;

(iii) Interim Application No.1302 of 2020 is disposed of. (PRAKASH D. NAIK, J.) MST
