The order dated 26.02.2016 passed by the Learned Member, Industrial Court No.2, Kolhapur, rejecting the application Exh.U-25 filed by the Petitioner for directing the Respondent Agricultural Produce Market Committee, is taken exception to by way of the above Petition. It seems that the Petitioner who is the original Complainant in Complaint (ULP) No.229 of 2008 has closed his evidence by filing pursis marked as Exh.U-24. It is after his evidence was closed that the Petitioner filed application Exh.U-25 for direction to the Respondent for production of documents. The Learned Member of the Industrial Court has rejected the application for two fold reasons, firstly that the Petitioner i.e. the Complainant has closed his evidence and secondly, considering BGP.

the relief sought in the Complaint not to recruit any person on the post of Junior Clerk or other post pending the Complaint, the said documents have no relevance.
In my view, having regard to the reasons on which the impugned order is founded, no case for interdiction in the writ jurisdiction of this Court under Article 227 of the Constitution of India is made out. The Writ Petition is accordingly dismissed. [R.M.SAVANT, J] BGP.
