Not on board. Learned counsel for applicant/petitioner submits that the parties have settled the matter and compromise deed has been executed. It is submitted that in view of the interim stay being granted in these petitions, the Trial Court could not proceed with compounding the matter. It is submitted that the complainant has submitted an application before the Trial Court for withdrawal of the complaint. The Trial Court passed an order on 30th July 2018 stating that in view of pendency of these petitions in the High Court, the Trial Court is unable to pass any order on the said application. In these circumstances, the petitions are sought to be withdrawn.

Accordingly, these petitions are allowed to be withdrawn and stand disposed off. The Trial Court may proceed with the application preferred by the complainant in accordance with law. In the event compromise fails, the applicant-petitioner in both these petitions will be at liberty to pursue the remedy which is sought in these petitions. Criminal Application No.1206 of 2017 and Criminal Writ Petition No.1994 of 2018 stand disposed off in above terms. (PRAKASH D. NAIK, J.) MST
