At the outset, learned Counsel for the petitioner seeks leave to withdraw the petition. She states that she intends to pursue the application i.e. Exhibit 5 filed in P.B. No. 11 of 2014, as a reply has been filed by the petitioner-husband in the said proceedings.

Accordingly, the petition is disposed of as withdrawn. 3.

It is made clear, that this Court has not considered the petition SQ Pathan 1/2

wp.4999.14.doc on merits and the learned Judge shall consider the same on its own merits, in accordance with law, uninfluenced by the withdrawal of the petition. 4.

The petitioner is always at liberty to move an application seeking early hearing of the Exhibit 5 application before the Family Court. It is for the Family Court to decide the urgency and accordingly fix the matter.
