This is an application for early hearing of the appeal in which the original complainant is challenging acquittal of the respondent recorded by the trial Court in R.C.C.No.1165 of 2009. Heard the learned Advocate appearing for the applicant/original complainant. He submitted that the applicant is a senior citizen and, therefore, the appeal needs to be heard. The appeal is of the year 2016. It is challenging acquittal. In view of the Judgment of the Honourable Apex Court in the matter of Hussain & Anr. v. Union of India reported in Gaikwad RD 1/2

(23)APPANo.6992017 2017 (5) SCC 702, this appeal of the year 2016 cannot be taken up for final hearing considering the pendency of the jail appeals before this Court.

Hence, the application is rejected.
