Learned counsel for the Appellant-Insurance Company submits that, in view of the Judgment of the Hon'ble Apex Court in the case of National Insurance Company Limited Vs. Pranay Sethi and Others, 2017 ACJ 2700, this Appeal has become infructuous and, therefore, Appellant-Insurance Company does not want to proceed with the same. A letter to that effect issued by the Appellant-Insurance Company dated 16th November 2018 is also produced on record, which is marked as 'Annexure-A'.

In view thereof, the Appeal stands disposed off as withdrawn. 4.
