1] Learned Counsel Mr. A.P. Kulkarni for respondent Nos.1 to 3 - Corporation, under instructions of Mr. Machale, Dy.Engineer, Zone-5, Pune Municipal Corporation, stated that the Corporation shall withdraw the impugned notice dated 17.12.2013 issued under Section 260 of the Maharashtra Municipal Corporations Act, 1949, however, with a liberty to issue a fresh notice if so needed after examination of full facts including those presented by the petitioner in the present petition. In that view of the matter, no further examination of the prayers of the petitioner is needed. Needless to add, in case of fresh notice is issued, the petitioner's rights and contentions would be open.
