Petitioners allege the prosecution was initiated by complainant Mrs. Rita Ajaykumar Kanojiya. Charge-sheet came to be filed for the offences punishable under Section 498-A, 406, 323, 504 read with section 34 of the Indian Penal Code. Learned counsel for petitioners submits that they are involved in the alleged offences by the complainant. APMC police station had no jurisdiction to investigate the crime.
Learned APP submits that charge-sheet has already been filed. The matter would be considered on its own merits.
rpa 2/2 wp-1737-16.doc At this stage, it is not appropriate to hear the grievances of the petitioners. Petitioners have alternate efficacious remedy. In the facts, at this stage no interference is warranted under extraordinary writ jurisdiction of this Court. By keeping all issues on merits open, petition is disposed of.
