This application is moved for anticipatory bail as the applicant/accused apprehends arrest in C.R. No.I-62 of 2015 for the offences punishable under sections 307, 143, 148, 149, 323, 504, 506 of the Indian Penal Code and under section 135 of the Mumbai Police Act registered with the Yeola Taluka police station, Nasik. It is the case of the prosecution that the applicant/accused and the co-accused, who were armed with weapons, assaulted the complainant and the other persons. 2.

The learned Counsel for the applicant/accused has relied on the order of this Court dated 6.5.2015 granting pre-arrest bail to the coaccused. 1 / 3

The learned Prosecutor has opposed the application and submitted that the applicant/accused was armed with weapon and he relied on the RFIR of Balu Dhanwate.

Perused the FIR and the order passed by my predecessor dated 6.5.2015 granting pre-arrest bail to the co-accused. It appears from the FIR that the role attributed to the co-accused and the present applicant/accused is of similar nature. My predecessor has observed that there is a fracture of nasal bone of the injured and such injury cannot be fatal to the life.

In view of the above, I pass the same order dated 6.5.2015 as under:

i) In the event of arrest, the applicant/accused shall be released on bail upon furnishing P.R. Bond in the sum of Rs.20,000/-, with one or two sureties in the like amount;

ii) The applicant shall not tamper with the evidence; iii) The applicant shall not indulge into any kind of offence muchless any offence in the village and against the complainant, while on bail;

iv) The applicant shall cooperate with the Investigating Officer and attend the concerned police station on the first Sunday of every month between 10 am to 12 noon for a period of six months from today.
