This Application is moved for condonation of delay of 90 days in filing First Appeal.

The learned counsel for the applicant submitted that he has filed additional affidavit in support of his prayer for condonation of delay. He submitted that the delay of 90 days is caused because the applicant underwent a heart operation and she was advised to take bed rest on 3rd February, 2013. She was bed ridden from 4th February, 2013 till 3rd May, 2013.

The learned counsel for the applicant to supply copy of the additional affidavit to the learned counsel for the respondent. In view of the submissions of learned counsel for the applicant and the reasons mentioned in the additional affidavit, delay is condoned. Civil Application is allowed.
