When this matter is called the learned counsel for the 3rd respondent states that the petitioner is offered Flat No.1502 on the property being developed bearing Survey No.2/1787 of Byculla Division. This statement is accepted as an undertaking to the Court. In view of the said statement, Mr.Godbole, learned Senior Advocate appearing for the petitioner states that he will not press the petition. 2.

The learned counsel for the 3rd respondent further states on instructions that his client will also offer the monetary compensation on the same lines as offered to other flat holders in respect of temporary accommodation in terms of the agreement to be signed. Mr.Godbole, learned counsel for the petitioner further states that the contents of draft agreement are not in dispute and will not be called into question.
