In this writ petition, the petitioner has prayed for the following relief: - "a.

Be pleased to issue a writ of mandamus or any other appropriate writ and thereby direct Respondent No.1, selection committee not to take the cognizance of the ACB case, filed against the Petitioner, wherein the Petitioner is already acquitted, while considering the selection of the Petitioner for the post of Member, Maharashtra Sales Tax Tribunal.

b.

Be pleased to issue a writ of mandamus or any other appropriate writ and thereby direct Respondent No.2 & 3 to send the appropriate confidential information/record to the selection committee without mentioning about the ACB case, as the Petitioner was acquitted by the competent Court."

On the last occasion, i.e., on 20th September, 2022, we recorded that the writ petition is premature. Hearing was adjourned to enable learned advocate for the petitioner to obtain instructions.

None appears for the petitioner today.

The respondents are represented.

Having regard to the nature of grievance expressed by the petitioner, we dismiss the writ petition as premature. No decision adverse to the interest of the petitioner has yet been taken. It shall be open to the petitioner to pursue his remedy in accordance with law if at all his selection as Member of the Maharashtra Sales Tax Tribunal is adversely affected by reason of the corruption case which was launched against him in the past and from which he has since been acquitted.
