This is an application for suspension of sentence and temporary bail on the ground that the marriage of the brother of the applicant is scheduled on 18.05.2017 at Gandhukuti Buddha Vihar, Rajiv Gandhi Nagar, Khadaki Bazar, Khadaki, Pune-03. 2.

Learned counsel for the applicant submitted that on an earlier occasion the applicant was released on furlough leave by the Competent Authority and he has surrendered before the Jail Authority within stipulated time.

Learned APP, on instructions from the concerned police station, submitted that the Investigating Agency has verified the fact of marriage of the brother of the applicant and the invitation card annexed to the application is genuine one. The learned APP further submitted that there is apprehension that the applicant may perhaps abscond when released on temporary bail and he may be directed to attend the said function in police escort.

In view of the above, we are inclined to release the applicant on temporary bail from 17.05.2017 to 19.05.2017 (both days inclusive). Hence, the following order:

(i) The applicant shall be released on temporary bail from 17.05.2017 to 19.05.2017 (both days inclusive) on his furnishing P.R. Bond of Rs.25,000/- and cash bail of Rs.25,000/-.

(ii) The applicant shall deposit the cash bail amount in the Registry of the Trial Court before his release from jail. (iii)The applicant shall be released on temporary bail in police escort. It is needless to mention that the applicant shall bear the necessary charges for police escort as per rules prescribed therein.

(iv) The concerned authorities are hereby directed to provide such police escort in civil dress.

(v) If the applicant surrenders to the Jail Authority within aforestated stipulated period, the cash bail amount deposited by the applicant shall be refunded to him on an application made by him without any demur.

(vi) The application is allowed in the aforesaid terms. (vii) The parties shall act on authenticated copies of this order.
