Heard the learned counsel for the applicant.

This application is preferred by plaintiff for restoration of First Appeal (ST) No.10566 of 2013 which was dismissed in view of conditional order dated 13.8.2013 passed by learned Registrar (Judicial-II) for non-removal of office objections. The learned counsel for the applicant undertakes to remove all office objections in First Appeal within four weeks from today.

Undertaking is accepted.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied Mohite 1/2

14 caf2318-14.doc that the Applicant has made out a case for allowing the present Civil Application. Hence, following order:

a) The order dated 13.8.2013 passed by learned Registrar (Judicial-II) is set aside.

b) First Appeal (ST) No.10566 of 2013 is restored on file.

c) Four weeks time is granted to the applicant to remove all office objections, failing which Civil Application shall stand dismissed without referring back to the court.

d) Civil application stands disposed off accordingly.
