The applicant who is in jail has filed this application seeking transfer of proceedings from the Trial Court mainly on the ground that there is delay in conducting the trial.

Learned advocate appointed to represent the applicant states that the Trial Court has framed charges and five witnesses have been examined. The aforesaid facts show that the trial is in progress.

However, it is pointed out that the accused has not been permitted to join the hearing of trial. The Sessions Judge, Court Room No.41, Mumbai is, therefore, directed to ensure that the applicant be permitted to attend the hearing of trial either inperson or through video conferencing. 4.

The criminal application stands disposed of. No costs. (AMIT BORKAR, J.)
