IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION WRIT PETITION NO.5266 OF 2014 The Public Information Officer/Dy. Registrar ... Petitioner Vs.
The Central Information Commission and Anr.
... Respondents -------------- Mr. Makarand Subhash Karnik, for the Petitioner. Mr. Sunil Kishore Ahya, for the Respondent No.2 in person. CORAM : A.S. OKA & A.K. MENON, JJ.
DATE : 8th JANUARY, 2015 P.C.
.
Heard the learned counsel appearing for the Petitioner and the second Respondent appearing in person. Though original affidavit filed by the second Respondent is not on record, a copy is produced for perusal of the Court. In paragraph 5 of the affidavit, the second Respondent has stated that in view of the orders passed by the State Information Commissioner, the Public Information Officer of this Court has provided relevant and requisite information to the second Respondent and, therefore, he does not want to prosecute the Second Appeals pending before the Central Information Commission.
wp-5266.14 2.
As the second Respondent does not want to prosecute the Appeals which are subject matter of challenge in this Petition, the Petition will not survive. However, the first Respondent will have to pass appropriate order on the basis of the statements of the second Respondent made in the affidavit filed before this Court. 3.
Accordingly, we dispose of the Petition by directing the second Respondent not to proceed with the Appeals subject matter of this Petition as the second Respondent does not desire to prosecute the said Appeals.
