The learned counsel for the petitioner submitted that the Writ Petition was dismissed by order dated 6th April, 2016 for non-removal of office objections. He has submitted that the Short Cause Suit No. 3461 of 2014 is decreed and in February, 2016 the Appeal filed against the said order is dismissed. He submitted that in Writ Petition, original plaintiff had challenged the order rejecting the Notice of Motion taken out under Order 39 Rule 11 of the Code of Civil Procedure. He submitted that as the suit is decreed and Appeal is dismissed, nothing remains in this Writ Petition. However, the Petition was dismissed for non-removal of office objections, so it can 1 / 2

502.RC1360_2016.doc be restored only for the purpose of record, as the learned counsel seeks permission to withdraw this Writ Petition immediately. 3.

In view of the submissions, though no separate application for restoration of Writ Petition is filed, Writ Petition is hereby restored to its file. The learned counsel for the petitioner is allowed to withdraw the Writ Petition.

Writ Petition is dismissed as withdrawn.
