IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION CIVIL APPLICATION NO.955 OF 2018 IN SECOND APPEAL (ST) NO.13142 OF 2017 Avinash Anant Karlekar ... Applicant Vs.

Vasnant Hari Karlekar ... Respondent Mr. Manas N.Gawankar for the Applicant.

Mr. Rakesh Bhatkar for the Respondent No.1.

CORAM : SMT. SADHANA S. JADHAV, J.

DATE : 4th MARCH 2020.

P.C.:

This is an application seeking condonation of delay in filing the second appeal. The delay is of 110 days. The learned counsel for the respondent vehemently objects to condoning the delay on the ground that there is no plausible explanation for the inordinate delay in filing the second appeal and hence, it has caused grave prejudice to the respondent who is decree holder. For the reasons assigned in paragraphs 4 and 5, delay of 110 days is condoned in the interest of justice. Application is allowed in terms of prayer clause (a) and stands disposed of. (SMT. SADHANA S. JADHAV, J.)
