The Applicant is seeking anticipatory bail in connection with C.R. No.202/2024 registered at Andheri police station, Mumbai on 8.4.2024 under Sections 406, 420, 465, 467, 468, 471 read with 34 of IPC.

At the outset, learned counsel for the Applicant fairly states that the Applicant has directly approached this Court without approaching the Court of Session for the relief under Section 438 of Cr.P.C. in connection with the present subject matter.

It would be appropriate if the Applicant approaches the Court of Session first. When I expressed my opinion to that effect, learned counsel for the Applicant sought permission to withdraw this Application with liberty to approach the Court of Session for the same relief under Section 438 of Cr.P.C. by keeping all the contentions raised in this Application open.

With such liberty, the Application is allowed to be withdrawn. If the Applicant approaches the Court of Session, said Anticipatory Bail Application shall be decided on its own merits in accordance with law without being influenced by withdrawal of this Application. The Application is disposed of accordingly.
