Heard the Learned Advocates appearing for the parties. Following order is passed, by consent :- (a) The Order passed by the Presiding Officer, Second Labour Court, Thane in Miscellaneous Application (IDA) No. 5 of 2011 in Reference (IDA) No.552 of 2002, dated 14 th March, 2016 is set aside.

(b) The Presiding Officer, Second Labour Court, Thane shall hear the Miscellaneous Application (IDA) No. 5 of 2011 in Reference (IDA) No.552 of 2002 afresh and decide the same within a period of four weeks from the date of this order. (c) All contentions of the parties including the issue pertaining to delay, are kept open.

(d) The parties and/or their Advocates shall appear before the Presiding Officer, Second Labour Court, Thane on 30th November, 2017 at 11.00 a.m. and obtain

(e) The parties shall not seek any adjournment unless absolutely necessary. The Presiding Officer, Second Labour Court, Thane shall also not adjourn the proceedings unless absolutely necessary.

(f) Parties shall not lead any further, oral or documentary evidence. (g) Office is directed to forthwith return the R & P to the Second Labour Court, Thane.

(h) All concerned to act on an ordinary copy of this order duly authenticated by the Personal Assistant of this Court.
