On 11/10/2022, when I expressed my disinclination to entertain the application on merits, it was pointed out to me that despite his incarceration since 04/05/2019, charge is not framed.

This resulted in a direction being issued to the trial Court to frame the charge in Sessions Case No.296 of 2019 within a period of six months and commence the trial.

It is informed that the trial has commenced, but the grievance of the learned counsel for the Applicant is, till date only one witness is examined out of the thirty two witnesses. In any case, it is not for this Court to charter the course of action of the trial Court, which is trying the Applicant for a serious offence of attempt to murder coupled with Section 34 of the Indian Penal Code.
