In view of objections raised by the Counsel for the Respondent on the maintainability of the petition, Shri. Gite, learned counsel for the Petitioner seeks permission to withdraw the Petition with liberty to file an appeal under Section 37 of the Arbitration Act. The Petition as such stands disposed of with liberty as prayed for.

Needless to clarify that in case if the issue of delay is cropped up, time spent from filing of the petition till disposal should be excluded.
