This is the 2nd Application for pre-arrest bail filed by the aforesaid Applicant apprehending his arrest in C.R.No.510/2022 registered with Dadar Police Station, Mumbai for offences punishable under sections 420, 406 r/w. 34 of the Indian Penal Code.

A perusal of the order dated 09/12/2022 reveals that the previous application for pre-arrest bail being Anticipatory Bail Application No.3422/2022 was withdrawn simplicitor. Learned counsel for the Applicant states that the co-accused have been released on bail.

Suffice it to say that the said ground cannot be the ground for entertaining the Application for pre-arrest bail. I am not inclined to 1/2

P.H. Jayani 23 ABA1280.2023.doc entertain the subsequent application for pre-arrest bail without there being any change in fact situation. Entertaining such Application will encourage forum shopping which is not conducive to administration of justice.
