This is an application for anticipatory bail. The applicant is apprehending arrest in connection with C.R. No.295 of 2018 registered with Park site Police Station, Mumbai for offences under Sections 406 & 420 of Indian Penal Code.

The case of the prosecution is that from December, 2015 to June, 2016 the accused had executed false contract inducing complainant to part with huge amount. The PVC goods were not supplied to complainant. The applicant was agent of accused Arun Kumar.

Learned counsel for applicant as well as the complainant have submitted that the parties have settled the dispute. Consent Sajakali Jamadar

9-Aba-894-2021.doc terms executed by the applicant and complainant dated 30th June, 2021 are tendered in the Court. The same is taken on record and marked as "X" for identification.

Learned counsel representing both the sides submit that the said consent terms are executed by the complainant and applicant. They are identified by representative advocates. It is submitted that, in view of consent terms, the complainant has no objection for allowing this application.

Hence, I pass the following order:

ORDER

(i) Anticipatory Bail Application No. 894 of 2021 is allowed;

(ii) Interim order dated 6th November, 2020 is confirmed. (iii) In the event of arrest of the applicant in connection with in C.R. No.295 of 2018 registered with Park site Police Station, Mumbai, the applicant be released on bail on furnishing P. R. Bond in the sum of Rs.25,000/- with one or more sureties in the like amount;

(iv) The applicant shall abide the terms stipulated in consent terms.

(v) Anticipatory Bail Application stands disposed of accordingly.
