The application is moved as the applicant-accused is facing prosecution under sections 419, 420, 406 r/w 34 of the Indian Penal Code in C.R. No.I-234 of 2013 at Kapurbawdi police station, Thane. The offence is registered on 29.6.2013 against the applicant-accused who is a builder/developer.

It appears from the record that the police did not give notice under section 41 of the Code of Criminal Procedure. In view of this, the police is directed to issue notice to the accused under section 41 of the Code of Criminal Procedure and conduct enquiry by following the procedure laid down thereunder. The applicant-accused shall remain present at the police station alongwith this order tomorrow at 4pm. In the event the 1 / 2
