The applicant-accused is prosecuted for the offences punishable under sections 420 r/w 34 of the Indian Penal Code and under sections 33 and 36 of the Maharashtra Medical Practitioners Act in C.R. No.79 of 2016 registered with Wadala T.T. police station on 15.2.2016. 2.

Upon enquiry, the leaned Prosecutor has submitted that the police have not issued notice under section 41 of the Code of Criminal Procedure.

In view of this, the police is directed to issue notice under section 41 and follow the procedure laid down thereunder. The applicant is directed to attend the concerned police station tomorrow at 11am. However, in the event the police decides to arrest the applicant-accused, they shall give the applicant-accused a 72-hours prior notice. 1 / 2
