Heard the learned counsel for the petitioner and the learned APP for the State.

The petition is filed seeking a direction to the Incharge Officer of Kapurbawdi Police Station to register the FIR on the basis of the petitioner's complaint.

Mrs. Deshmukh, the learned APP placed on record a report dated 17th December, 2014 by Police Inspector (Administration), Kapurbawdi Police Station, Thane which shows that the petitioner's said complaint was inquired into and they arrived at the conclusion that the dispute between petitioner and their cousin is of civil nature and accordingly the petitioners are informed.

In the aforesaid circumstances, we find that the petitioner has alternate efficacious remedy available to approach the learned Magistrate by way of private complaint. We are therefore, not inclined to interfere in this matter under the provisions of Article 226 of the Constitution of India. Petition is accordingly dismissed. (V.L.ACHLIYA, J.) (RANJIT MORE, J.) 2/2
