Mr. Mundergi, the learned senior counsel appearing for the Petitioner has submitted that the prosecution has not yet examined the material witnesses viz. Tushar Mutke, Dattatray Shantaram Khandebharad, Mahendra Laxmidas Gori, Suhas Madhukar Gaikwad, Amit Bajrang Mane, Deepak Ashok Durgesht, Sachin Namdeo Ghobale. 2.

Mr. Sait, the learned APP after taking instructions from the Investigating Officer, who is present in the Court, states that endeavour will be made to record evidence of the said seven witnesses viz. Tushar Mutke, Dattatray Shantaram Khandebharad, Mahendra Laxmidas Gori, Megha 1/2

2_ba_986_2016.doc Suhas Madhukar Gaikwad, Amit Bajrang Mane, Deepak Ashok Durgesht, Sachin Namdeo Ghobale, within a period of four months from the date of receipt of copy of this order. Statement is accepted. 3.

The learned senior counsel also makes a statement that the accused will cooperate and will not delay the trial. The learned senior counsel seeks leave to withdraw the application with liberty to file fresh application after evidence of said seven witnesses is recorded. Leave with liberty as prayed for is granted.
