Learned counsel for the parties have jointly tendered a copy of Consent Terms filed by the parties in Petition No. E-140 of 2021 filed in Family Court at Bandra. The copy of the Consent Terms is taken on record and marked 'X' for identification. According to Clause 8 of the Consent Terms, the Respondent has today handed over the Pay Order of Rs.1,00,000/- to the Appellant. Learned counsel for the Appellant submits that his client has issued a letter dated 20th February, 2023 requesting to withdraw the present Appeal, as agreed under the Consent Terms, mentioned above. The said letter is taken on record and marked 'Y' for identification.

In that view of the matter, this Family Court Appeal is dismissed as withdrawn. No order as to costs. 4.
The Respondent-Husband is present in the Court. Learned counsel appearing for the Respondent, on instructions, submits that Respondent undertakes to pay Rs.6,00,000/-, as agreed under Clause 10 of the Consent Terms. Undertaking is accepted. It is clarified that if the Respondent does not pay, as agreed under the Consent Terms, the Appellant will be at liberty to apply for restoration of the Family Court Appeal.
